U ovom clanku autor nastoji da analizira odnos morala i prava u okviru savremene pravne teorije. Odnos prava i morala moze se posmatrati na tri razlicita nacina: teza o identitetu - pravo i moral su osnovi identicni sistemi normi pri cemu su pozitivne pravne norme podredjene osnovnim moralnim principima (prirodna pravna teorija), teza o odvajanju - pravo i moral su konacno razliciti sistemi normi (pravni pozitivizam), teza o polaritetu - pravo i moral su dva razlicita normativna sistema, ali se oni (...) medjusobno radikalno ne iskljucuju, vec izmedju njih postoji znacajan nivo dodirivanja i nadopunjavanja. Ova teza na najbolji nacin je predstavljena u pravnim teorijama H.L.A Harta i Ronalda Dworkina. Na logickom nivou, teza o polaritetu na specifican nacin sintetise i prevladava jednostranosti teze o identitetu i teze o odvajanju. U isti mah na socioistorijskom nivou, ova teza proizvod je specificnog istorijsko-socijalnog razvitka angloamerickih pravnih i politickih institucija. U tekstu se ukazuje i na relevanciju ove teorijske kontraverze pri suocavanju sa prosloscu posttotalitarnih politickih poredaka i drustava. (shrink)

This edited collection covers Friedrich Waismann's most influential contributions to twentieth-century philosophy of language: his concepts of open texture and language strata, his early criticism of verificationism and the analytic-synthetic distinction, as well as their significance for experimental and legal philosophy. -/- In addition, Waismann's original papers in ethics, metaphysics, epistemology and the philosophy of mathematics are here evaluated. They introduce Waismann's theory of action along with his groundbreaking work on fiction, proper names and Kafka's Trial. -/- Waismann is known (...) as the voice of Ludwig Wittgenstein in the Vienna Circle. At the same time we find in his works a determined critic of logical positivism and ordinary language philosophy, who anticipated much later developments in the analytic tradition and devised his very own vision for its future. This article examines the global and worsening problem of research misconduct as it relates to bio-medico-legal education. While research misconduct has serious legal implications, few adequate legal remedies exist to deal with it. With respect to teaching, research ethics education should be mandatory for biomedical students and physicians. Although teaching alone will not prevent misconduct, it promotes integrity, accountability, and responsibility in research. Policies and law enforcement should send a clear message that researchers should adhere to the highest standards of (...) ethics in research. It is vital that researchers and physicians understand basic aspects of law and the legal system in order to develop understanding of the medico-legal issues not just in the legal context, but with a sound grounding in ethics, social and theoretical contexts so that they can practice good medicine. Routine and holistic research ethics education across the curriculum for medical students and resident physicians, and continuing medical education for practicing doctors, are probably the best ways to accomplish this goal. Anxiety disorders are among the most prevalent mental disorders. Present treatments such as cognitive behavior therapy and pharmacological treatments show only moderate success, which emphasizes the importance for the development of new treatment protocols. Non-invasive brain stimulation methods such as repetitive transcranial magnetic stimulation and transcranial direct current stimulation have been probed as therapeutic option for anxiety disorders in recent years. Mechanistic information about their mode of action, and most efficient protocols is however limited. Here the fear extinction model can (...) serve as a model of exposure therapies for studying therapeutic mechanisms, and development of appropriate intervention protocols. We systematically reviewed 30 research articles that investigated the impact of rTMS and tDCS on fear memory and extinction in animal models and humans, in clinical and healthy populations. The results of these studies suggest that tDCS and rTMS can be efficient methods to modulate fear memory and extinction. Furthermore, excitability-enhancing stimulation applied over the vmPFC showed the strongest potential to enhance fear extinction. We further discuss factors that determine the efficacy of rTMS and tDCS in the context of the fear extinction model and provide future directions to optimize parameters and protocols of stimulation for research and treatment. The aim of this article is to explore the evolving discussion surrounding vulnerability and flourishing. This conversation has gained significant relevance in the aftermath of the COVID-19 pandemic and amid global uncertainties, including the effects of violence and war-trauma. The central idea here is to reconsider vulnerability and flourishing not simply as universal experiences tied to one's own humanity and social context, but rather as co-existing, interdependent, and contingent aspects of human existence. Without proposing that human flourishing is conditioned by (...) vulnerability, this perspective seeks to challenge the notion that vulnerability and flourishing are fundamentally separate. The following discussion will not only examine vulnerability and flourishing as theoretical concepts but will also address their practical significance as integral components of the human experience, and how they intersect in a real-life situation. It's important to note that both vulnerability and flourishing are influenced by specific contexts and circumstances, including personal, social, economic and cultural factors. In the course of this discussion, I will provide examples to illustrate these points. The first section will focus on vulnerability, while the second will delve into the concept of flourishing from a Christian perspective, drawing on Miroslav Volf's ideas about a flourishing life. Gas will increasingly be seen as the fossil fuel of choice, especially when considering environmental impacts. Natural gas is the chance for Serbia for sustainable development and with its intensive consumption in the XXI century to conciliate the 4Es (Energy, Economy, Efficiency and Environment). In this paper we will compare the impact of different fossil fuels used for domestic heating with a special emphasis on natural gas. Some other causes of climate changes will be also discussed such as the Milanković (...) astronomical cycles. These factors will be compared with climate changes caused by the consumption of fossil fuels. (shrink)

Summary Amodal completion involves the impression of existence and properties of visually occluded parts of objects. One aspect of this phenomenon that has been somewhat neglected is the amodal completion of color, which involves the impression that amodally completed surfaces have a particular color. In this paper, this aspect is investigated by constructing a large number of displays with identical target figures embedded in systematically varying contexts, to find out which contexts are conducive for amodal completion of color and which (...) are not. In this setup, the main effects of changes of contexts are changes of geometric and photometric features of junctions along the borders of the target regions, which can cause dramatic differences in the appearance of those regions. Generally, a certain arrangement of T-junctions supports the impression of amodal completion of color, and it can be argued that certain types of X-junctions support a variant of this effect as well. U podrucju manjinskih prava EU promovira norme koje nemaju uporiste u zakonodavstvu EU i koje nisu dio pravne stecevine EU. Limiti uvjetovanosti implementacije manjinskih prava koje EU promovira vidljivi su mehanizmu pracenja te implementacije, ukljucujuci i redovna izvjesca Evropske komisije o napretku zemlje ka EU koja prate manjinske probleme u politickom kontekstu neke zemlje. Izvjesca se baziraju na Kopenhagenskim kriterijima o zastiti manjina. Potrebni su ozbiljni napori u implementaciji zakonskih normi manjinskih prava. Nekoliko faktora utice na implemenatciju: konfuzija oko pravne (...) prirode zastite manjinskih prava, neodre?enost formulacije standarda i koristi koje bi njihovim provo?enjem neka zemlja imala. Kako svi ti faktori ne bi doprinosili daljnjoj nedorecenosti, EU mora ujednaciti i jasno definirati standarde manjinskih prava, uvjeravajuci vlade da postojanje manjinskih grupa obogacuje drustvo, a mjere usmjerene na ocuvanje njihove specificnosti utjecu na smanjenje rizika od konflikta.Iako se na primjeru Hrvatske moze vidjeti da su usvojene, promjenom zakonodavstva, mnoge evropske norme zastite manjina, iz izvjesca Evropske komisije najblize je moguce vidjeti i njihovu limitiranost, tj. ne primjenjivanje zakona u realnost. Izvjesca Evropske komisije o napretku prikazuju da manjinski problem nije prioritet EU u pristupnim pregovorima, te poteskoce EU u pracenju napretka u nedostatku jasno definiranih mjerila u podrucju manjinskih prava. A general framework for the explanation of perceptual phenomena as internalizations of external regularities was developed by R. N. Shepard. A particular example of this framework is his account of perceived curvilinear apparent motions. This paper contains a brief summary of the relevant psychophysical data, some basic kinematical considerations and examples, and several criticisms of Shepard's account. The criticisms concern the feasibility of internalization of critical motion types, the roles of simplicity and uniqueness, the contrast between classical physics and kinematic (...) geometry, the import of perceived path curvilinearity, and the relation of perceptual and scientific knowledge. Anthropologists of the ontological turn claim that certain entities, processes, and relations are in principle inaccessible to outsiders of specific communities. Philosophers of ethnobiology see a challenge to the integration of scientific and ethnoscientific knowledge of nature in this claim. They propose to negotiate integration within a framework of overlapping ontologies. I explicate the methodology of the ontological turn and claim that it offers a better understanding of knowledge integration than does the philosophers’ framework. Every linear perspective image has a center of the perspective construction. Only when observed from that location does a 2D image provide the same stimulus as the original 3D scene. Geometric analyses indicate that observing the image from other vantage points should affect the perceived spatial structure of the scene conveyed by the image, involving transformations such as shear, compression, and dilation. Based on previous research, this paper presents a detailed account of these transformations. The analyses are presented in a (...) uniform manner, illustrated with special 3D diagrams, and embedded in a wider framework of related perspective paradigms. Such analyses provide the potential theoretical basis for empirical work on the effects of changes of observer vantage points on the perception of spatial structure in perspective images. (shrink)

Transitionaljustice mechanisms and the International Criminal Tribunal for the FormerYugoslavia (ICTY) have had only a limited success in overcoming ethnic divisionsin Bosnia-Herzegovina. Rather than elaborating upon the role of local politicalelites in perpetuating ethnic divisions, we examine ordinary peoples’ popularperceptions of war and its aftermath. In our view, the idea that elites havecomplete control over the broader narratives about the past is misplaced. Weargue that transitional justice and peace mechanisms supported by externalactors are always interpreted on the ground in context-specific (...) ways, creatingdifferent citizens’ experiences, “memories” of the war, and their respectivehopes and disappointments in regards to the relationship between peace andjustice in Bosnia. We suggest that analyses of the post-conflict developments inBosnia-Herzegovina must take into account what gives the narratives ofexclusion their power, and what are the objective political, social andeconomic constraints that continue to provide a fertile ground for theirwidespread support. In The Oyster, multiple disciplines (philosophy, literature, visual art, biology, architecture) converge within the experiences of thinking, eating, and diagramming. The center stage is given to a humble mollusk, which becomes an object, a subject, a sentient consciousness, and an alien will, progressively and then even simultaneously.

While most research in public relations and strategic communication concentrates on textual elements, this contribution shifts the focus to the growing importance of visual elements. The theoretical background is based on visual theory and the concept of strategic mediatization. By using a large-scale quantitative survey among 3,387 European communication professionals, this study is the first empirical evidence of communication professionals’ perspectives concerning visual communication. Therefore, the paper empirically demonstrates a visual turn in strategic communication. Although practitioners have been using visual (...) elements since the very beginnings of their trade, only a minority guide these activities through a sound management process. This calls for a deeper consideration of visual communication management in practice and visual public relations research in academia. (shrink)

The visible condition of a person in bodily pain or of a person who has lost autonomy, social status or self–representation, reveals to some degree an invisible reality which is present in every human being. Assuming the validity of this premise, my primary purpose in the following paper is first to reflect upon social and cultural attitudes that consider disability and vulnerability as a boundary and a threat; and secondly, to propose an alternative in transgressing the differences of socio - (...) anthropological boundaries in order to enable dynamic communication with fellow human beings, and ultimately, to bring about the true human flourishing. The structure of my argument is threefold. In a first part my focus is stressed upon concerns of those living with a physical condition of disability and a mainstream socio–cultural attitudes towards it. In the second part, my attention will be on the meaning of vulnerability associated with, but distinct from the notion of disability. Thirdly, I will elucidate my argument with concrete examples from the L´Arche community - where people with and without disabilities are living together in mutual interdependency and cooperation. We introduce a notion of simplicity for types in discretely ordered first order structures. We prove that all the structure on the locus of a simple type is induced exclusively by the ordering relation. As an application we determine all possible expansions of satisfying CB = 1.

The topicality of Friedrich Nietzsche’s thought is reflected in his critique of mass culture, society and the state, and scientific methods, which later had a significant impact on modern discourse. Mass culture is the foundation of modern social reality as a force of decadence and nihilism that degrades the authentic and creates a mediocre culture. Nietzsche opposed a “culture” that implies a transcendence and sublimation of “nature” into the forms of “moral” ideals, and he called for a natural life without (...) harmful cultural influences that are an obstacle to a healthy human life. The idea of nihilism present in culture is relevant to our time because it manifests as a loss of depth or meaning in life itself, which, like nature, is chaos, without structure or empirical evidence. To understand the scientific revolution and its impressively devastating pace in the high-tech laboratories of our global research ecosystem, relevant is Nietzsche’s perspective aimed at demystifying science, especially positivism and naturalism, which seek to impose truth based on scientifically verified knowledge. Scientific interpretations and constructions are efforts to control and “humanise” nature by adapting chaos to our anthropomorphic expectations, needs, and concerns and making chaotic nature predictable. The paper shows that Nietzsche’s critique of culturalism and naturalism is based on the vision of the life of the “last man human” who rejects the culture of self-overcoming and dismantles reduces the fear of the uncertain and sudden and lives enframed in reality as presented by the scientific community. In the life of the contemporary human being, the will to live is merely maintained because he lacks the will to power. (shrink)

The argument from causal closure of the physical is usually considered the most powerful argument in favor of the ontological doctrine of physicalism. Many authors, most notably Papineau, assume that CCP implies that physicalism is supported by physics. I demonstrate, however, that physical science has no bias in the ontological debate between proponents of physicalism and dualism. I show that the arguments offered for CCP are effective only against the accounts of mental causation based on the action of the mental (...) forces of a Newtonian nature, i.e. those which manifest themselves by causing accelerations. However, it is conceivable and possible that mental causation is manifested through the redistribution of energy, momentum and other conserved quantities in the system, brought about by altering the state probability distribution within the living system and leading to anomalous correlations of neural processes. After arguing that a probabilistic, interactionist model of mental causation is conceivable, which renders the argument from causal closure of the physical ineffective, I point to some basic features that such a model must have in order to be intelligible. At the same time, I indicate the way that conclusive testing of CCP can be done within the theoretical framework of physics. (shrink)
